Terms of Service

barklynu.com (the "Site") is operated by Barkly Nutrition LLC, an Idaho limited liability company ("Barkly", "we", "us", "our"). By using the Site, creating an account, or placing an order, you agree to these Terms and to our Privacy Policy, Shipping Policy, and Refund Policy, each of which is part of this agreement. If you do not agree, please do not use the Site or order from us.

You must be at least 18 years old and able to enter into a binding contract to order from us. The Site is intended for customers in the United States, and we currently sell and ship only within the United States.

We may update these Terms as our business changes. When we do, we'll change the "Last updated" date at the top of this page, and the updated Terms apply to use of the Site and to orders placed from that date forward. Your order is governed by the version of these Terms in effect when you placed it. Please check back from time to time.

You don't need an account to browse, but you'll have one to manage a subscription. We use passwordless sign-in: we email a secure link to the address on your order, and clicking it signs you in. Anyone with access to your email can therefore access your account, so keep your email secure and let us know right away if you think someone else has used your account.

You agree to give us accurate, current information and to keep it up to date. We may suspend or close an account that is used for fraud, abuse, or any breach of these Terms.

Barkly Daily is a dietary supplement for dogs. It is not a medicine, and nothing on the Site is veterinary advice. Our products are not intended to diagnose, treat, cure, or prevent any disease.

Feed according to the directions on the jar. If your dog has a health condition, is pregnant or nursing, is taking medication, or is scheduled for surgery, talk to your veterinarian before starting any supplement. Stop use and contact your veterinarian if your dog has an adverse reaction. Keep the product out of reach of children and pets, and don't use it in animals other than dogs.

You are responsible for deciding whether a product is appropriate for your dog and for following the feeding directions and any advice from your veterinarian.

We work hard to describe our products accurately, including ingredients, doses, and images. Even so, product packaging, formulas, and photography can change, and colors can vary between screens. The ingredient panel on the jar you receive is the authoritative one. If a product you receive is materially different from what was described, tell us and we'll make it right under our Refund Policy.

Products are offered subject to availability. We may change, limit, or discontinue any product or plan at any time.

Your order is an offer to buy. A confirmation email acknowledges that we received your order; a contract is formed when we accept your order and ship it.

We may decline, limit, or cancel any order, including after a confirmation is sent, for reasons such as suspected fraud, a payment we can't verify, an address we can't ship to, quantity limits, product unavailability, or an error in the price or product description. If we cancel an order you already paid for, we refund it in full.

Prices, promotions, and product listings on the Site can contain errors. We reserve the right to correct any error and to cancel affected orders rather than honor an incorrectly stated price.

All prices are in US dollars. Applicable sales tax and any shipping cost are calculated and shown at checkout before you pay. Prices can change at any time, but a change never affects an order you have already placed.

By submitting payment information you represent that you are authorized to use the payment method and you authorize us, and our payment processor, to charge it for the total shown, including recurring charges for a subscription plan you select. If a payment is declined or reversed, we may cancel or hold the affected order and we may retry the charge and email you to update your payment details.

Payments are processed by a third-party payment processor. Card details are entered directly into the processor's secure fields and we never store your full card number on our servers. Your use of a payment method is also subject to your card issuer's terms.

If you see a charge from us you don't recognize, email or call us before disputing it with your bank. We can usually resolve it the same day.

Subscriptions renew automatically at the cadence you choose and bill the price shown at signup until you cancel. Each plan is a supply of Barkly Daily, delivered and billed in week-based cycles: a 1-month supply is delivered and billed every 4 weeks (13 billings a year), a 2-month supply every 8 weeks, a 3-month supply every 12 weeks, a 4-month supply every 16 weeks, and a 6-month supply every 24 weeks. The exact interval and amount are shown on the plan you pick and again in your order summary before you pay, and you agree to them at checkout.

There is no free trial and no introductory rate that steps up later. You pay the price shown from the first order.

You can cancel, skip, or change your plan anytime in your account. Changes apply from your next renewal, so make them before your renewal date. Cancelling stops all future renewals and charges; it does not cancel an order that has already shipped. Your renewal date is always visible in your account, and cancellation details are in our Refund Policy.

If we change the price of an active subscription, we'll email you before the change takes effect so you can cancel or change your plan first.

Shipping costs, processing times, delivery estimates, and how subscription shipments work are set out in our Shipping Policy. Delivery estimates are estimates, not guarantees, and carrier delays are outside our control.

Title and risk of loss pass to you when the carrier delivers the package. That said, if your order is lost, stolen, or damaged in transit, tell us and we'll make it right as described in our Shipping and Refund policies.

Purchases are covered by our 90-day tail-wag guarantee. What it covers, how to claim it, how refunds are paid, and how damaged or incorrect orders are handled are all set out in our Refund Policy, which forms part of these Terms.

Discount codes and promotions are subject to the terms stated with the offer. Unless we say otherwise, one code applies per order, codes have no cash value, cannot be applied to a prior order, and can't be combined with other offers. We may change or end a promotion at any time, and we may cancel orders or void codes obtained through error, abuse, resale, or fraud.

You may be able to submit reviews, photos, videos, or other content. Content you submit must be your own, honest, and about your real experience, and it must not be unlawful, misleading, infringing, or offensive.

You keep ownership of what you submit. By submitting it you give us a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, adapt, publish, and display it in connection with Barkly and our marketing, along with any name or handle you provide. We may decline to publish, edit for length or clarity, or remove any submission, and we don't pay for submissions unless we agree otherwise in writing and disclose it.

Please use the Site lawfully and reasonably. You agree not to: use the Site for fraud or any unlawful purpose; buy for resale without our written permission; scrape, harvest, or copy the Site or its content by automated means; interfere with or attempt to breach the Site's security; upload malware; reverse engineer any part of the Site; impersonate anyone; or harass our team or other customers.

The Barkly name, logo, packaging, product formulas, photography, text, graphics, and the design of the Site belong to Barkly Nutrition LLC or our licensors and are protected by intellectual property laws. You may use the Site for your own personal, non-commercial purposes. You may not copy, reproduce, or use our content or branding for any other purpose without our written permission.

The Site may link to or rely on third-party sites and services. We don't control them and we're not responsible for their content, products, or privacy practices. Their terms apply to your use of them.

When you order or create an account, we'll send you transactional messages such as order confirmations, shipping notices, renewal and payment notices, and account emails. These are part of the service and are not marketing.

If you opt in, we may also send marketing emails, and text messages to a mobile number you provide. You can unsubscribe from marketing emails using the link in any of them, and stop texts by replying STOP. Message and data rates may apply. Opting out of marketing does not stop transactional messages. You agree that we may communicate with you electronically and that electronic agreements, notices, and records satisfy any requirement that they be in writing. How we handle your information is described in our Privacy Policy.

To the fullest extent permitted by law, the Site and its content are provided "as is" and "as available", without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted or error free.

Dogs are individuals, and results vary. We do not promise any particular health, mobility, coat, digestion, or other outcome from using our products. Nothing in this section limits your rights under our Refund Policy or any warranty that cannot be excluded by law.

To the fullest extent permitted by law, Barkly Nutrition LLC and its owners, employees, and suppliers are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of your use of the Site or any product.

Our total liability for any claim relating to an order is limited to the amount you paid for that order. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, or for death or personal injury caused by negligence.

You agree to indemnify and hold harmless Barkly Nutrition LLC and its owners and employees from any claim, loss, or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or content you submit.

If something goes wrong, contact us first at support@barklynu.com. Most issues are resolved quickly and at no cost to you. You agree to give us 30 days from that first contact to resolve a dispute informally before starting any formal proceeding.

These Terms and any dispute arising from them or from an order are governed by the laws of the State of Idaho, USA, without regard to its conflict of laws rules. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Idaho, and you and we consent to the jurisdiction of those courts.

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including carrier delays, supplier or manufacturing failures, natural disasters, severe weather, labor disputes, outages, or government action.

We may suspend or terminate your access to the Site or your account, and cancel pending orders, if you breach these Terms or use the Site for fraud or abuse. Sections that by their nature should survive termination, including sections 12, 14, and 17 through 20, survive.

These Terms, together with our Privacy Policy, Shipping Policy, and Refund Policy, are the entire agreement between you and us about the Site and your orders. If any provision is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver of it. You may not assign your rights under these Terms; we may assign ours in connection with a merger, acquisition, or sale of assets. Headings are for convenience only.
